We may monitor your account to ensure that you are complying with these Terms. We will comply with our Privacy Policy if we do. We may investigate any alleged misuse of the Service and may involve police or other law enforcement agencies in doing so without notice to you. We will cooperate with law enforcement agency investigations which may involve disclosures of information in response to legally issued notices. We are also obliged to allow law enforcement agencies to monitor and intercept communications using our Services.
If our monitoring of your account or an investigation by a law enforcement agency demonstrates that you are in material breach of these Terms (ie a breach which is serious, in all the circumstances), we may terminate your account.
In these Terms: 'you' and 'your' mean the customer (you); 'we', 'our' and 'us' mean GrabaDiscount Pty Limited; and our 'Services' means the provision of services via http://www.GrabaDiscount.com.au or any other site owned by GrabaDiscount Pty Ltd.
By signing up to become a business advertiser, you agree to the terms & conditions and agreement to these has the same effect as if you had actually signed these Terms.
GrabaDiscount reserves the right to modify or remove any item that you may place on this site - this includes any discount voucher or business profile page that you may create.
If on review, the content you have provided is viewed as inappropriate, we reserve the right to remove the content. If we believe this content is extremely inappropriate we may remove you account. In removing your account, you have broken this agreement and forfeited any monies that you have paid to GrabaDiscount.
Information that you publish (including but not limited to any items listed) must not:
1. be false, inaccurate or misleading;
2. be fraudulent or involve the sale of counterfeit or stolen items;
3. infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
4. violate any applicable law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, criminal law, antidiscrimination or trade practices/fair trading laws);
5. be defamatory, trade libelous, unlawfully threatening or unlawfully harassing;
6. be obscene or contain child pornography or, if otherwise adult in nature or harmful to persons under the age of 18 years, shall be distributed only to people legally permitted to receive such content.
7. contain any content that may be considered to be prohibited or potentially prohibited content for the purposes of the Broadcasting Services Act 1992 (Cth) (for more information about this legislation, please refer to the Internet Industry Association's Codes of Practice located at http://www.iia.net.au or http://www.aba.gov.au);
8. contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;
9. create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers
4. Members By signing up to become a member, you agree to the terms & conditions and agreement to these has the same effect as if you had actually signed these Terms.
When viewing business profiles and associated discounts, we track this interaction. When you join to become member you provide the following infromation to us - your age, gender, occupation and postcode.
This information is statistical in nature and is provided to the business advertiser - which allows the business to better understand their market.
We will never provide personal information such as first and last name, address details or email address to any business advertiser. These details will never be shared - your privacy is our primary concern.
5. No Warranty WE PROVIDE OUR WEB SITE AND SERVICES ON AN "AS IS" BASIS AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. TO THE EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Furthermore we do not guarantee continuous, uninterrupted or secure access to our services, and operation of our Site may be interfered with by numerous factors outside our control.
6. No Liability IN NO EVENT SHALL WE BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE). YOU AGREE THAT GRABADISCOUNT AND RELATED ENTITIES OF GRABADISCOUNT HAVE NO RESPONSIBILITY FOR THE LEGALITY OF OUR MEMBERS' ACTIONS.
7. Indemnity You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from and against any claims, demands, proceedings, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including reasonable solicitors' fees, made by any third party due to or arising out of your breach of this Agreement or the terms and policies it incorporates by reference, or your violation of any law or the rights of a third party.
8. Amendments to these Terms We may amend this Agreement at any time in our discretion by posting the amended terms on our Site. Amended terms shall automatically be effective 30 days after they are initially posted on our Site. If you do not agree with such changes, you must terminate your membership of GrabaDiscount.
